SAVE Terms of Service
Effective date: October 27, 2026
Last updated: October 27, 2026
Please read these Terms carefully. Three points matter most:
- Paid plans renew automatically every month and we charge your payment method each month until you cancel. You can cancel at any time online at https://saveprivacy.net/cancel (linked as "Manage or cancel subscription" on every page and in our emails; every receipt also links to the page where you manage your Subscription), or by email. See Sections 9 and 10.
- We cannot guarantee results. We submit removal requests for you, but each website decides whether and when to remove your information, and information can reappear. See Section 5.
- Disputes go to individual arbitration, not court. Section 20 requires most disputes to be resolved by binding individual arbitration. It also waives class actions and, where the law allows, jury trials. You can opt out of arbitration within 30 days (Section 20.11).

1.1 Who we are. SAVE is operated by NEXT MATH INC, a corporation organized under the laws of Delaware, with its mailing address at 220 East 23rd Street, STE 400, New York, NY 10010, United States ("SAVE," "we," "us" or "our"). NEXT MATH INC is the seller: it sells the Services, is the merchant of record for every payment, is responsible for charges, refunds and customer support, and is the party you contract with under these Terms. Our contact details are in Section 26 and at https://saveprivacy.net/contact.
1.2 What these Terms cover. These Terms of Service (the "Terms") are a binding contract between you and us. They apply when you:
(a) visit our website at https://saveprivacy.net (the "Site");
(b) use our free privacy check (the "Free Check");
(c) buy or use a paid plan (Section 4), or are covered by one as a Family Member (Section 7); or
(d) receive emails from us or write to us.
Together, these are the "Services."
1.3 How you accept these Terms. You accept these Terms when you:
(a) submit the Free Check form by tapping the button next to the notice that says continuing means you agree to these Terms;
(b) on our checkout page, check the box agreeing to the automatic renewal terms shown right above it (your plan renews automatically every month until you cancel), click "Agree and continue" below the notice that clicking it accepts these Terms and our Refund & Cancellation Policy and appoints us as your authorized agent (Sections 6.1 and 9.2), and then complete your purchase; or
(c) as a Family Member, sign the authorization described in Section 7.3.
If you only browse the Site, these Terms apply to that use to the extent the law allows. If you do not agree, do not use the Services.
1.4 Related documents.
(a) Refund & Cancellation Policy at https://saveprivacy.net/refunds. It forms part of these Terms and gives the full rules on billing, cancellation and refunds. If it conflicts with these Terms on a billing, cancellation or refund question, the Refund & Cancellation Policy controls. For everything else, including how disputes are resolved (Section 20), these Terms control.
(b) Order details. These are the plan, price and renewal terms shown to you at checkout. They form part of these Terms. If they conflict with these Terms on the price or plan you bought, the order details control.
(c) Privacy Policy at https://saveprivacy.net/privacy. It explains how we collect, use and share personal information, and how to use your privacy choices. Its Notice at Collection is at https://saveprivacy.net/privacy#notice-at-collection, and you can opt out of the sale or sharing of your personal information at https://saveprivacy.net/do-not-sell. The Privacy Policy describes our practices and is not a contract.
1.5 Defined terms. In these Terms:
- "Breach Database" has the meaning given in Section 3.1(a).
- "Covered Person" means each person the paid Services cover. On an Individual plan, that is you. On a Family plan, it is you and each Family Member.
- "Data Broker" means a people-search, data-broker, background-check or similar website or company that collects and publishes or sells information about people.
- "Family Member" means a person other than the Subscriber who is added to a Family plan under Section 7.
- "Household" means the people who live at the same residential address. For the money-back guarantee in Section 11, we identify a Household by the billing ZIP code given at checkout, together with the Subscriber's email address, the payment method and the names of the Covered Persons.
- "Initial Payment" means the first charge on a Subscription.
- "Intake Form" means the short form in which a Covered Person gives us details that help us find their Listings, such as other names they have used and the cities and states where they have lived, or the same details sent to us by email. The Subscriber's form is on the page shown right after payment; if they do not complete it there, they can reply with the details to the email in which we ask for them (Section 4.2(a)). An adult Family Member gives them by replying to their invitation email, the same reply in which they authorize us (Section 7.3). A Covered Person completes it by submitting the form or sending us those details, or by telling us that they have nothing to add.
- "Listing" means a profile, record or page about a Covered Person on a Data Broker site.
- "Removal Request" means an opt-out, deletion, suppression or similar request that we submit to a Data Broker on behalf of a Covered Person.
- "Report" means an email report about a Covered Person's Listings and Removal Requests, as described in Section 4.2.
- "Subscriber" means the person who buys and pays for a Subscription.
- "Subscription" means a paid, automatically renewing monthly plan: Individual or Family.
The words "include" and "including" mean "including without limitation." "We" includes service providers that act for us under our instructions when they perform part of the Services.
2.1 Who may use the Services. You may use the Services only if you:
(a) are at least 18 years old and have reached the age of majority where you live;
(b) live in the United States; and
(c) can form a binding contract.
2.2 Personal use only. The Services are for personal, family and household use. You may not use them on behalf of a business or to provide services to others.
2.3 Children. The Services are not directed to children. We do not knowingly collect personal information from anyone under 18, and no one under 18 can be added to a Family plan (Section 7.2).
2.4 Our right to decline. We may decline to provide the Services to anyone, for example if we cannot verify identity or authority.
3.1 What the Free Check does. When you submit the Free Check form, we:
(a) when the breach check is on, send the email address you entered to a third-party breach-database provider (the "Breach Database") to check whether that address appears in data breaches the Breach Database has cataloged, and show you the result: how many breaches include your address, their names and years, and the types of data each one exposed; and
(b) show you an estimated privacy exposure score, the reasons behind it, the types of Data Broker sites that commonly list people in the United States (for example, people-search sites), and suggested next steps.
When the breach check is off, we do not send your email address to any breach database and do not show breach results. The Free Check then shows only the estimate in (b), and the results page says that the breach check is off.
3.2 How the estimate works. The exposure score is an estimate built from a small number of inputs:
(a) whether the Breach Database lists your email address in known data breaches, and in how many;
(b) what those breaches exposed, for example passwords, phone numbers or home addresses;
(c) whether you gave us a phone number;
(d) the country we estimate you are in from your internet connection; and
(e) a baseline that applies to everyone, because names, email addresses and phone numbers are widely traded.
We show each factor and how much it adds to or subtracts from the score. If the breach check is off or the Breach Database does not answer, the score is built from the other inputs only, and we tell you so. The Free Check does not search any Data Broker site for you. The site types we show are general information about the industry. They do not show or confirm that any particular site lists you, or that it does not. Do not rely on them as a statement of fact about any specific site. We search Data Broker sites for you only as part of a paid Subscription (Section 4).
3.3 Breach results come from a third party. The Breach Database's data may be incomplete, delayed or inaccurate, and we do not control it. If no breaches are found, that does not mean your email address has never been exposed. The Breach Database is not affiliated with SAVE and does not endorse us. We may change the breach database we use.
3.4 Check only your own email address. You may run the Free Check only on an email address that belongs to you, or one you are authorized to check.
3.5 The Free Check is free. We do not ask for payment details for the Free Check, and it never turns into a paid Subscription on its own. After the Free Check, we may email you about your check and our paid plans, and you can unsubscribe at any time (Section 13.3). You do not have to buy anything.
3.6 Your phone number. The Free Check form asks for your phone number. We use it only to find and remove your Listings if you subscribe; for the Free Check estimate, we note only whether you gave one (Section 3.2(c)). We never call or text you.
4.1 Plans.
(a) Individual (shown on the Site as "SAVE Individual") costs $3.99 per month and covers one person: you.
(b) Family (shown on the Site as "SAVE Family") costs $11.00 per month and covers you plus up to 4 other adults (18 or older) in your Household, each of whom authorizes SAVE. Section 7 applies.
4.2 What a Subscription includes. While your Subscription is active, we will do the following for each Covered Person:
(a) Intake. Right after payment, our Site shows your Intake Form: a short form where you can add other names you have used and the cities and states where you have lived. It does not ask for your date of birth or any ID number, and we use what you add only to find and remove your Listings. If you do not complete it there, we email you within one business day after checkout to ask for the same details, and you can reply to that email with them. If a Data Broker needs more to match a Listing to you, such as your age or another phone number or email address, we ask you by email, and you can say no. You appointed us as your authorized agent at checkout (Section 6.1), so you don't need to sign anything else to get started (a few sites may ask for a separate signed authorization, Section 6.4(a)). On a Family plan, we email each adult Family Member their own invitation, and they authorize us by replying to it (Section 7.3).
(b) Full check. We search the people-search and other Data Broker sites we cover for Listings. The sites we cover, currently 450+ sites, are listed with the date of the list at https://saveprivacy.net/covered-sites.
(c) First Report. We email a Report that lists the sites we checked and the Listings we found, with screenshots of those Listings.
(d) Removal Requests. We submit Removal Requests to each covered site where we find a Listing, acting as the Covered Person's authorized agent (Section 6).
(e) Monthly re-checks. About once a month, we re-check the covered sites. If a Listing reappears, we submit a new Removal Request.
(f) Monthly Report. Each month, we email a Report on the status of the Removal Requests and the results of the re-check. Section 7.5 explains who receives Reports on a Family plan.
4.3 The sites we cover change. We decide which Data Broker sites we cover. Sites open, close, merge and change their opt-out processes, and some stop accepting requests from agents. We will add and remove sites over time and keep the list at https://saveprivacy.net/covered-sites up to date. The number of covered sites describes current coverage. It is not a promise of a fixed number of sites.
4.4 Timing. We aim to send the first Report within 3 business days after a Covered Person completes their Intake Form (an adult Family Member must also have signed their own authorization, Section 7.3). We start a Covered Person's full check only then. Data Brokers set their own processing times. Many take several weeks to process a request, and some take longer.
4.5 What a Subscription does not include. Unless we agree otherwise in writing, a Subscription does not include:
(a) requests to remove content from Google or other search engines. However, removing a Listing at its source often makes the matching search result disappear over time;
(b) removing information from social media, news sites, websites you control, or government, court or other public records;
(c) disputing information with credit bureaus, or any credit, insurance or account service;
(d) help recovering from fraud or misuse of your accounts;
(e) submitting requests for you through California's Delete Request and Opt-out Platform (Section 5.3); or
(f) legal advice or legal representation.
4.6 Work starts right away. You ask us to start the Services as soon as you pay. Our records of the work we do for you (searches run, screenshots taken, Removal Requests submitted, Data Broker responses, our emails with you and Reports sent) show what we did for you. If you dispute a charge, we may give your card issuer a summary of them (the names of the sites we checked or contacted and the dates and status of the requests), as Section 9.7 describes. Starting work does not affect the 30-day guarantee in Section 11.
4.7 Reasonable use. For each Covered Person, we search using up to 5 names, 10 current and past addresses, 5 phone numbers and 5 email addresses. On a Family plan, you may replace a Family Member up to 2 times in any 12 months, and each new adult must sign their own authorization (Section 7.3).
4.8 Reports show a point in time. Each Report, and each screenshot in it, shows what a site displayed when we last checked. A Listing marked as removed may have been hidden rather than deleted, and it may reappear. We send a Covered Person's Reports only to that person's email address (Section 7.5). Reports contain your personal information, so keep them private.
4.9 Service delivery at a glance.
(a) Start. The Services start as soon as your Initial Payment goes through, and so does our appointment as your authorized agent (Section 6.7(a)). The page you see right after paying shows a confirmation of your Subscription and its terms, which we also email to you, and your Intake Form. If you do not complete the Intake Form there, we email you within one business day to ask for the same details, and you can reply with them (Section 4.2(a)).
(b) First Report. We aim to send it within 3 business days after a Covered Person completes their Intake Form (Section 4.4).
(c) Removal Requests. After the full check, we submit Removal Requests to each covered site where we find a Listing, normally by the time we send the first Report, and list them in it. Each site then acts on its own timeline: many take several weeks, some take longer, and some ask the Covered Person to confirm the request.
(d) Monthly re-checks. About once a month, we re-check the covered sites, submit a new Removal Request where a Listing has come back, and email a monthly Report (Sections 4.2(e) and 4.2(f)).
(e) When a site refuses or re-lists. If a site refuses a request, ignores it, asks the Covered Person to verify or submit it themselves, or does not accept requests from agents, we say so in the Report and, where practical, explain how to do it yourself (Section 6.4). If a Listing reappears, we file again at the next re-check while your Subscription is active.
(f) No guarantee of permanent removal. Sites decide whether to remove information and may publish it again later (Section 5).
(g) If we fail to deliver. If we do not provide the Services in a month you paid for, Section 17.2 applies: we re-perform the work or refund that month's payment in full.
5.1 Data Brokers decide. Data Brokers are independent third parties. We do not control them. A Data Broker may:
(a) refuse or ignore a Removal Request;
(b) require the Covered Person to verify their identity or confirm the request directly;
(c) take a long time to act;
(d) hide a Listing from public view instead of deleting the underlying data; or
(e) publish the same or new information again later from new sources.
State laws that give people a right to delete or opt out differ, and many Data Brokers honor requests only voluntarily.
5.2 No guarantee of results. We will make reasonable efforts to provide the Services described in Section 4. We do not guarantee that:
(a) any particular information will be found or removed;
(b) removed information will stay removed; or
(c) the Services will prevent identity theft, fraud, scams, spam, unwanted calls, harassment or any other harm.
The outcome of a Removal Request is not, by itself, grounds for a refund. This does not limit your rights if we fail to provide the Services you paid for (Sections 11 and 17.2), or our right to refund at our discretion (Section 11.4).
5.3 You can do this yourself for free. You have the right to contact Data Brokers directly, and many offer a free opt-out process. California residents can also use the state's free Delete Request and Opt-out Platform (DROP) to send one deletion request to the data brokers registered in California. We do not submit DROP requests for you. Our paid Services save you the work on the sites we cover: we search, file, follow up, re-check and report for you.
5.4 Not legal advice, and not an emergency or safety service. We are not a law firm, and we do not give legal, financial or security advice. If you believe your safety is at risk, contact 911 or local law enforcement. Do not rely on the Services to protect you in an emergency. If you are a victim of domestic violence, stalking or harassment, the Services are not a substitute for a safety plan, a protective order or your state's address confidentiality program. Do not rely on our Reports to decide whether someone can find you.
5.5 Estimates. Timeframes we mention are general estimates, not a promise about your case.
6.1 Appointment. When you click "Agree and continue" on our checkout page, directly below the notice that says so, and then complete your purchase, you appoint NEXT MATH INC as your authorized agent. An adult Family Member appoints us with their own authorization (Section 7.3). If you bought your Subscription before our checkout notice included this appointment, you appoint us instead by signing the separate authorization we email you (an electronic signature, such as your typed name in a reply, is fine); until you do, we do not search for you or submit any Removal Request for you. Our team members and the service providers that act for us under our instructions may carry out the tasks below under this appointment. You authorize us to:
(a) search Data Broker sites for your Listings and take screenshots of them for your Reports and our records;
(b) submit Removal Requests in your name. These include requests to delete, to opt out of sale, sharing or targeted advertising, and similar requests under state privacy laws that allow authorized agents (for example, the California Consumer Privacy Act), as well as requests that Data Brokers accept voluntarily;
(c) complete and submit Data Broker forms for you, giving each site the information it reasonably needs to find and process your Listing;
(d) communicate with Data Brokers about your requests and receive their responses; and
(e) re-submit requests when Listings reappear.
6.2 Limits on our authority. This appointment is limited to the tasks in Section 6.1. It does not make us your lawyer and is not a general power of attorney. Under it, we will not:
(a) open accounts or make purchases for you;
(b) pay any money on your behalf, or accept for you any term that requires you to pay money;
(c) agree to anything that binds you, except as Section 6.3 allows; or
(d) start any legal proceeding.
We will not submit a request you have told us not to submit.
6.3 Data Broker forms and terms.
(a) Some Data Brokers accept a request only after the person confirms a statement on their form or accepts their terms. You authorize us to do that for you, except as (b) says.
(b) Some of those terms include an arbitration agreement, a class-action waiver or a similar waiver of legal rights. We do not accept such terms for you. If a site will process a request only when such terms are accepted, we do not submit the request there. We tell you in your Report, and you decide whether to submit the request yourself or to ask us by email to accept that site's terms for you. Any terms accepted for you are between you and that Data Broker.
(c) We do not ask for or collect a copy of your government ID or any part of your Social Security number. If a Data Broker will not process a request without them, we tell you in your Report and, where practical, explain how to submit the request yourself (Section 6.4(c)). Otherwise, we give a Data Broker only the information it needs to find and process your Listing. This may include an email address so that it can confirm your request.
(d) A Data Broker may keep the information in a request so that it can keep you suppressed. Its own policies govern that.
6.4 Proof of authority and verification.
(a) When a site asks for proof that we act for you, we give it a statement of your appointment made from your checkout consent record (Section 9.2): your name, the words of the notice you accepted with the label of the "Agree and continue" button, the date and time you clicked it, and our legal name. It does not include your IP address, device or card details, or anything else from that record. For an adult Family Member, and for a Subscriber who signed a separate authorization under Section 6.1, we use that signed authorization instead. If a site needs a separate written authorization, you agree to sign one that we reasonably request. An electronic signature, such as your typed name in an email reply, is fine.
(b) Some Data Brokers will contact you directly to verify your identity or to confirm that you authorized us, for example by an emailed link. You agree to respond promptly.
(c) Some Data Brokers do not accept requests from agents. Where practical, we will tell you in your Report how to submit the request yourself.
6.5 Your confirmations. You confirm that:
(a) the information you give us is true and accurate;
(b) it is about you, or about a Family Member you may add under Section 7;
(c) you want us to submit the requests described in this Section; and
(d) you will tell us promptly if any of this changes.
6.6 How we use information we collect as your agent. We use information we collect from or about you in our role as your authorized agent (for example, past addresses, date of birth, other names, screenshots of your Listings and Data Broker responses) only to:
(a) submit, follow up on and verify Removal Requests and otherwise provide the Services you asked for, including your Reports;
(b) prevent fraud, including payment-dispute fraud and misuse of the money-back guarantee in Section 11;
(c) keep a record of the work we did; and
(d) comply with the law.
We give each Data Broker only the information it needs to find and process the Listing. Service providers that help us provide the Services may use this information only for that purpose. We protect this information with reasonable security measures, as described in our Privacy Policy. We do not sell it, share it for targeted advertising or use it to market to you. Information you gave us before you appointed us, such as your Free Check form, is handled as our Privacy Policy describes.
6.7 How long the appointment lasts.
(a) Your appointment starts when your Initial Payment goes through (for an adult Family Member, when they sign their own authorization under Section 7.3; for a Subscriber who signs a separate authorization under Section 6.1, when they sign it). It ends when the Subscription ends, when a Family Member leaves the plan, or when you revoke it by emailing [email protected], whichever comes first.
(b) Revoking the appointment does not withdraw requests already submitted. Those stay with the sites that received them.
(c) We cannot provide removal services without this appointment. So if a Subscriber revokes it for themselves, we will treat that as a request to cancel the Subscription under Section 10, unless they tell us otherwise.
7.1 You plus up to 4 other adults. A Family plan covers you and up to 4 Family Members, so up to 5 Covered Persons in total. The price is the same however many people you add.
7.2 Who you may add. You may add a person only if all of these are true:
(a) they are an adult (18 or older);
(b) they live in your Household; and
(c) they agree to be added and authorize SAVE themselves: before we search for them or submit any Removal Request for them, they must sign their own authorization as Section 7.3 describes.
You may not add anyone under 18, and you may not resell or share a Family plan with others.
Each time you add a person, you confirm that this Section is satisfied.
7.3 Adult Family Members sign for themselves. When you add an adult under Section 7.2, you give us their name and email address, and we email them their own invitation. It contains the full text of our authorization and links to these Terms and our Privacy Policy. To join, they reply to that email from their own email address, and in that reply they:
(a) sign their own authorization appointing us as their authorized agent under Section 6, by typing their full name;
(b) accept these Terms, including their own right to opt out of arbitration under Section 20.11; and
(c) acknowledge our Privacy Policy.
They can give us their Intake Form details in the same reply.
Until they do, we collect from you only their name and email address, and we do not provide the Services for them. If they decline, or do not respond within 60 days, we delete the details you gave us about them, except a record that we sent the invitation and what the answer was. If we cannot confirm that a person meets Section 7.2, we may decline to add them or remove them from the plan.
7.4 Family Members' choices. An adult Family Member may at any time ask us to stop acting for them, withdraw their agreement to share a status summary with you, or remove them from the plan. We will honor the request. Removing a Family Member does not change the price or create a refund.
7.5 Reports.
(a) An adult Family Member's Reports are private to them. We send them only to that Family Member.
(b) You can see whether each adult Family Member has accepted the invitation and is covered (for example, "invitation sent," "pending authorization" or "active").
(c) We share a status summary with you (for example, how many sites we found and how many requests are complete) only if the adult Family Member agrees when they sign up. They can withdraw that agreement at any time.
(d) We never share with you the contents of an adult Family Member's Listings or Reports, such as their screenshots, addresses, phone numbers or relatives.
7.6 Contacting Family Members. We contact an adult Family Member only by email, and only to invite them, to confirm their authorization and to provide the Services. We never call or text them, and we do not send them marketing emails unless they sign up for them themselves.
7.7 The Subscriber controls the Subscription. Only the Subscriber can change the plan (by email to us, as Section 9 of our Refund & Cancellation Policy describes), update the payment method or ask for a refund. Only the Subscriber, or someone the Subscriber has authorized, can cancel. When a Family plan ends, the Services end for every Covered Person.
8.1 Give us accurate information. Keep your email address current so that receipts, Reports and notices reach you.
8.2 Help us help you. The Services depend on information and verification that only you can provide. If you do not complete the Intake Form, do not provide information we reasonably request, or do not respond to a Data Broker's verification request, we may be unable to complete some Removal Requests. That is not a failure by us to provide the Services.
8.3 Privacy. Our Privacy Policy explains how we handle personal information. That includes the information we receive from the Site, our analytics, the Meta Pixel and our payment processor, and the choices you have, such as opting out of "sale" and "sharing" for targeted advertising.
9.1 AUTOMATIC RENEWAL. WHEN YOU BUY A SUBSCRIPTION, YOUR SUBSCRIPTION RENEWS AUTOMATICALLY EVERY MONTH UNTIL YOU CANCEL. WE WILL CHARGE YOUR PAYMENT METHOD THE MONTHLY PRICE WHEN YOU CHECK OUT AND THEN ON YOUR BILLING DATE EACH MONTH (SECTION 9.2; THE CHECKOUT PAGE AND YOUR CONFIRMATION EMAIL SHOW IT). THE MONTHLY PRICE IS $3.99 FOR INDIVIDUAL OR $11.00 FOR FAMILY, OR ANY NEW PRICE WE HAVE NOTIFIED YOU OF UNDER SECTION 12. YOU CAN CANCEL AT ANY TIME ONLINE OR BY EMAIL (SECTION 10). CANCELING STOPS ALL FUTURE CHARGES, AND YOUR PLAN STAYS ACTIVE UNTIL THE END OF THE MONTH YOU HAVE ALREADY PAID FOR. TO AVOID THE NEXT CHARGE, CANCEL BEFORE YOUR NEXT BILLING DATE.
9.2 Your consent at checkout. Before the payment form appears, our checkout page shows a block titled "Renews automatically". In plain view inside that block, right above the box described below, and not behind a link or a button, it states: the plan you chose, who it covers and what it does, and that removal is not guaranteed; the amount due today, in U.S. dollars, and that the same amount is then charged every month on your Billing Date until you cancel, with the rule your Billing Date follows; how to cancel, online or by email, the date of the next charge and that you must cancel before then to avoid that charge, and that your plan stays active until the end of the month you have paid for, with no refund of partial months except as our Refund & Cancellation Policy says; and that the price may change and that we email you first. You must then check one box, which is never checked in advance. It sits inside the same block, directly below those terms, and says "I agree to the automatic renewal terms above." Directly above the "Agree and continue" button, with nothing between them, a notice states that by clicking it you agree to these Terms, including Section 20, and to our Refund & Cancellation Policy, appoint us as your authorized agent to file opt-out requests for you (Section 6.1), and acknowledge our Privacy Policy, each document linked. Directly below the button, the page states "By continuing you enroll in automatic renewal", next to a "Details" button. "Details" opens, on the same page, the full list of what your plan includes, with a link to the dated list of the sites we cover (Section 4.3); that if the price goes up, we email you at least 10 and no more than 30 days before your first charge at the new price, and you can cancel before then (Section 12.2); that there is no minimum term; that our money-back guarantee covers your first payment only, how to ask for it and its limits (Section 11); the name that will appear on your card statement; and the payment methods we accept and who processes the payment. When your monthly charge time is close to midnight where you are, "Details" also explains why a charge can fall a day earlier or later. Below "Details", in plain view and in the same size of text as the body of the renewal terms, the page names the seller, NEXT MATH INC, with its full street address, 220 East 23rd Street, STE 400, New York, NY 10010, United States, and says how to get these details and our refund policy by email. Until you check the box and click "Agree and continue", the payment form does not appear. Next to the payment button, the payment form repeats that by subscribing you enroll in automatic renewal, charged today and then every month at that price until you cancel, with the link to cancel, that your plan stays active until the end of the month you have paid for, with no refund of partial months except as our Refund & Cancellation Policy says, and that the price may change and we email you first. It also states that you confirm your agreement to these Terms and the Refund & Cancellation Policy, appoint us as your authorized agent, acknowledge our Privacy Policy and authorize us to charge the monthly price, or a new price we have emailed you about at least 10 days ahead, until you cancel. The payment form may also show its own box agreeing to these Terms; if it does, you cannot pay until you check it. While the payment form is on screen, the page beside it keeps showing the renewal terms, how and by when to cancel, that the price may change, and the seller with its street address and country. We charge you only after you click the payment button.
Your Billing Date is the date each month on which our payment processor charges you. It follows the moment of your Initial Payment: the processor charges at the same time each month, on the same day of the month counted in Coordinated Universal Time (UTC), or on that month's last day when it has no such day. Where you are, that is usually the same day of the month as your Initial Payment (or the last day of a shorter month); for a purchase made in the evening in U.S. time near the end of a month it can be the last day of every month, or the second-to-last day of a shorter month, and for a purchase made close to midnight a charge can fall on the day before or after. The checkout page states the rule that applies to you and the date of your next charge, and so do your confirmation email and every renewal reminder.
When you check the box and click "Agree and continue", we record: the exact words of the box and that you checked it; the exact words of the notice above the button (including the words that appoint us as your authorized agent) with a fingerprint of them and the button's label; the words the notice and the button showed on your screen when you clicked (as our page read them back); where the notice was when you clicked and which version of our checkout page you saw; the full text of the checkout disclosure you were shown (the "Renews automatically" terms, the statement below the button, what "Details" contained and the seller line) with its version and a fingerprint of it (a SHA-256 hash, which shows the text was not changed later), each of those parts on its own with where it appeared, and the dates it named and your time zone; whether you opened "Details" before you clicked; whether our page found the renewal terms above the box and the seller line laid out on the page (not collapsed or hidden) when you clicked; the version of these Terms, the Refund & Cancellation Policy and our Privacy Policy that the notice linked (each one's effective and "Last updated" dates and a fingerprint of its text); the words shown next to the payment button; the plan, price and currency; the date and time; and the IP address, browser and approximate country you used. Once you have paid, we add your email address, the identifiers of your payment, customer record and subscription, and the brand, last four digits and our payment processor's fingerprint of the card charged. We keep that record as proof of your consent for the life of your Subscription plus 5 years, as Sections 3.4 and 12 of our Privacy Policy describe.
After your Initial Payment, you receive a receipt by email, and we email you a confirmation that you can keep. It states your plan and what it includes; the amount charged today and the monthly amount that follows, every month on your Billing Date until you cancel; your next charge date; that the price may change and how we tell you first (Section 12.2); the card charged (its brand and last four digits); that there is no minimum term; our full cancellation and refund policy, including the 30-day money-back guarantee on your first payment and its deadline; how to cancel and by when; a copy of the automatic renewal terms shown above the box, of the exact wording of the box you checked and of the notice you accepted; and our name, address, email and phone number. The page you see right after paying shows the same confirmation, and your Intake Form; if you do not complete it there, we email you within one business day to ask for the same details (Section 4.2(a)).
9.3 Authorization to charge. By subscribing, you authorize us, through our payment processor, to charge the amounts described in Section 9.1 to the payment method you provide until you cancel. This includes a debit card, and a card used through Apple Pay or Google Pay. You confirm that you are authorized to use that payment method. If your card is replaced or its expiration date changes, your card issuer may give our payment processor the updated details. We may then use them to continue your Subscription.
9.4 How payments work. You pay on our Site through our payment processor's embedded payment form, by card, Apple Pay or Google Pay. Our payment processor processes the payment, and its own terms and privacy policy, which its payment form links to, apply to that processing. We never see or store your full card number. Charges appear on your statement as SAVEPRIVACY. We never call or text you, and we will never ask for your full card number, bank login or security code by email. If someone claiming to be from SAVE calls or texts you, or asks for these details, do not give them. Contact us instead.
9.5 Receipts and reminders. We email a receipt for every charge. Each receipt includes a link to manage or cancel your Subscription. Before each renewal charge (about 7 days ahead), we also email you a reminder with the amount, the date of the charge and how to cancel. Once a year, 25 to 40 days before the renewal that starts each new 12-month period of your Subscription, we email you a yearly reminder of your plan, its price and billing frequency, the date of that renewal and how to cancel; if you have not received one during a calendar year, we send it in December. California Subscribers (by the billing address given at checkout) also receive the notice in Section 24.1(a) each year on or before June 30.
9.6 Failed payments. If a payment fails, we will email you. Our payment processor may retry the charge for a limited period, as described in our Refund & Cancellation Policy. During that period, we keep re-checking sites, but we may pause new Removal Requests. If you cancel during that period, the retries stop and your Subscription ends right away; the payment that failed is not charged (Refund & Cancellation Policy, Section 10.2). If the payment still fails, your Subscription ends. We will not charge you for any period after your Subscription ends.
9.7 Billing questions and disputes.
(a) If a charge looks wrong, contact us first at [email protected]. We can usually fix billing problems faster than a bank dispute can. Nothing in these Terms limits your right to dispute a charge with your bank or card issuer.
(b) If you dispute a charge, we cancel your Subscription right away, so that your payment method is not charged again, and the Services end as Section 22.4 describes. We confirm this by email.
(c) If your card issuer warns us that a charge may not have been authorized (an "early fraud warning," which comes before any dispute), we refund that charge in full to the payment method it was made with, unless it has already been refunded or disputed, and cancel the Subscription right away.
(d) We may give your card issuer the records it needs to decide a dispute, such as your checkout consent, receipts, our emails with you about your Subscription, a delivery log of the Reports we sent (dates and recipient address only) and a summary of the work we did (the names of the sites we checked or contacted and the dates and status of the requests; Section 4.6). We do not give it your removal details, such as your date of birth or past addresses, the contents of your Reports or screenshots of your Listings.
(e) We will never refuse you future service or charge you a fee because you disputed a charge you did not authorize. Our Refund & Cancellation Policy describes how we handle charges you say you did not make (Section 7.1(b)) and payment disputes (Section 11).
9.8 Your billing agreement in brief. For each Subscription:
(a) What you buy: the Services described in Section 4.2 for the plan you choose: Individual (one person) or Family (you plus up to 4 other adults in your Household).
(b) Amount and currency: $3.99 (Individual) or $11.00 (Family) per month, in U.S. dollars, or a new price we have notified you of under Section 12. That is the total you pay: no tax or other fee is added.
(c) Timing and frequency: charged when you check out, then automatically every month on your Billing Date (Section 9.2) until you cancel. There is no minimum term.
(d) How we use your stored payment method: Our payment processor stores the payment method you give at checkout. We charge it only for your Subscription's monthly price on each billing date (after a plan change you ask for, the new plan's price, from the billing date the change takes effect: Refund & Cancellation Policy, Section 9), and for nothing else.
(e) How we tell you about changes: by email to the address on your Subscription: a reminder before each renewal charge (Section 9.5), a price increase at least 10 days and no more than 30 days before your first charge at the new price, with the right to cancel before then (Section 12.2), and other material changes as Section 23.2 describes.
(f) Merchant: NEXT MATH INC, 220 East 23rd Street, STE 400, New York, NY 10010, United States; email [email protected]; phone +1 (347) 690-0190; https://saveprivacy.net/contact. Charges appear on your statement as SAVEPRIVACY.
(g) Cancellation and refunds: cancel at any time at https://saveprivacy.net/cancel or by email (Section 10). Refunds are covered by Section 11 and our Refund & Cancellation Policy, including the 30-day money-back guarantee on your first payment.
10.1 How to cancel. You can cancel at any time, for any reason, in either of these ways:
(a) Online: go to https://saveprivacy.net/cancel (the "Manage or cancel subscription" link at the bottom of every page of our Site and in our emails) and choose Manage or cancel subscription. Our payment processor asks for the email address on your Subscription and emails you a secure sign-in link or code; you then cancel in its secure customer portal and confirm. Every receipt also links to that portal. You do not need to contact anyone or give a reason.
(b) By email: email [email protected] and tell us you want to cancel. Any email that clearly asks us to cancel counts, whatever its subject line. If you write from an address that is not on your Subscription, include the name and email address on the Subscription. We cancel within one business day after we receive your email and confirm by email. Your cancellation counts from the time we receive your email.
10.2 When cancellation takes effect. When you cancel, we stop all future charges right away. Your Subscription stays active until the end of the month you have already paid for, and we keep working until then. If you cancel while a renewal payment has failed and is being retried (Section 9.6), the month you paid for has already ended, so your Subscription ends right away. After that, we stop re-checking sites, submitting new Removal Requests and preparing Reports. Requests already submitted stay with the sites that received them. There is no cancellation fee. Within 10 business days after the Services end, we email you a final status summary listing the sites we submitted requests to and the last status we recorded for each. On a Family plan, each adult Family Member receives their own summary. If we charge you after you canceled, we will refund that charge in full.
10.3 Confirmation. We confirm every cancellation by email. If you do not receive a confirmation, contact us.
10.4 No obstacles. We may tell you what canceling ends. Online, the option to finish canceling stays visible throughout, and you can finish without seeing any offer. If you cancel by email, we cancel first; any offer comes in our confirmation, at most once, and never delays or conditions the cancellation.
10.5 No refund of partial months. We do not refund the unused part of a month when you cancel, except as stated in Section 11 and our Refund & Cancellation Policy, or where the law requires.
11.1 30-day money-back guarantee (Initial Payment only). If your Subscription qualifies under Section 11.2, you can get a full refund of its Initial Payment. It does not cover any later payment, including one at a new plan's price after you change plans. To ask, email [email protected] within 30 days after the date of the Initial Payment and tell us you want a refund. Any email that clearly asks for a guarantee refund counts, whatever its subject line. You do not need to give a reason.
11.2 Conditions.
(a) The guarantee applies only to the Initial Payment of a new Subscription. It does not apply to renewal payments, including payments at a new plan's price after a plan change. Changing plans does not create a new Subscription.
(b) The guarantee is available only once per Subscriber, once per Household, once per payment method and once per Covered Person. A card used through Apple Pay or Google Pay counts as the same card. The guarantee does not apply if a guarantee refund was already given for an earlier Subscription that was paid for by you, by anyone in your Household or with the same payment method, or that covered anyone this Subscription covers.
(c) When we issue a guarantee refund, we cancel your Subscription immediately and stop providing the Services. Removal Requests already submitted stay with the sites that received them.
(d) The guarantee does not apply to a payment you have already disputed with your bank or card issuer. The dispute process applies instead.
11.3 Other payments are non-refundable, except in these cases:
(a) billing errors, duplicate charges, charges made after you canceled (Section 10.2), and charges you did not authorize, as our Refund & Cancellation Policy describes;
(b) when we end your Subscription or stop providing the Services for a reason other than your breach of these Terms (Sections 22.2 and 22.3);
(c) the refund after a price increase described in Section 12.3;
(d) a material reduction in the Services (Section 12.5), or a transfer you do not accept (Section 25.2);
(e) when we fail to provide the Services and cannot re-perform them (Section 17.2);
(f) a refund we choose to give under Section 11.4; and
(g) any other case where the law requires a refund.
11.4 Refunds at our discretion. We may also give a full or partial refund in a case that Sections 11.1 to 11.3 do not cover, for example when we could not submit any Removal Request for a Covered Person because none of the sites we cover listed them or accepted a request from an agent. Whether to refund, and how much, is our decision. A refund in one case does not oblige us to give one in another.
11.5 Full details. Our Refund & Cancellation Policy explains how to ask for a refund, how quickly we process it, and how plan changes, failed payments and payment disputes are handled.
12.1 We may change prices. We may change the price of a Subscription. A new price never applies to a month you have already paid for.
12.2 Advance notice. If we raise the price of your existing Subscription, we will email you at least 10 days and no more than 30 days before your first charge at the new price. The email will state the new price, when it takes effect, and how to cancel, and you can keep it. If you do not want to pay the new price, cancel before it takes effect and you will not be charged it.
12.3 Refund after a price increase. If you did not actively agree to the new price and you cancel within 14 days after your first charge at the new price, we will refund the unused part of that charge, prorated by day. This applies wherever you live.
12.4 We may change the Services. We may update, improve, add or remove features, tools and covered sites.
12.5 Material reductions. We may make a change that materially reduces the core Services described in Section 4.2 during your Subscription. If so, we will email you in advance where practicable. You may then cancel within 30 days after the change takes effect, and we will refund the unused part of your current month, prorated by day. Changes to the list of covered sites in the ordinary course are not material reductions (see Section 4.3).
12.6 Pricing errors. If a price shown on the Site or at checkout is clearly wrong because of an error, we may cancel the order before or after you pay and refund what you paid. We will never charge you more than the price you agreed to without your consent.
13.1 Email only. We communicate with you by email. We do not make phone calls or send text messages to Free Check users, Subscribers or Family Members, for sales, support or anything else. If you receive a call or text that claims to come from SAVE, it is not from us. Please tell us at [email protected].
13.2 Service emails. If you subscribe, we email you what we need to provide the Services: receipts, the confirmation of your Subscription and the terms you agreed to, requests for your Intake Form details, Reports, monthly Reports, a reminder before each renewal charge, a yearly reminder (Section 9.5), cancellation confirmations, price-change notices and legally required notices. Every one of them tells you how to cancel. These are part of the Services, so you cannot unsubscribe from them while you have a Subscription.
13.3 Marketing emails. We may email you about your Free Check and our paid plans. Every marketing email has an unsubscribe link. We honor unsubscribe requests as soon as practical, and in any case within 10 business days. Unsubscribing does not stop the service emails in Section 13.2.
13.4 Consent to electronic signatures, records and communications (E-SIGN). You agree that checking a box, clicking a button or typing your name to accept these Terms, to subscribe or to sign an authorization is your electronic signature, and that it and our electronic records have the same effect as a handwritten signature and paper records, under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN) and state law. You agree that we may provide these Terms, our policies, receipts, confirmations, renewal reminders, price-change and other notices, Reports and other communications to you electronically, by email to the address you gave us or on the Site, and that they satisfy any legal requirement that a communication be in writing. To receive and keep them, you need an email account, a device with a current web browser and internet access, and the ability to save or print emails and web pages. Email notices are effective when we send them to the email address you gave us, so keep it current (Section 8.1). You can ask for a free paper copy of any notice by emailing [email protected]. You can withdraw this consent at any time by emailing [email protected]. Because the Services are provided only online and by email, withdrawing it ends your Subscription at the end of your paid month, as a cancellation under Section 10.
You agree that you will not:
(a) give us information about another person, or ask us to act for them, unless you have authority under Section 7;
(b) run the Free Check on another person's email address without their permission;
(c) use the Services to locate, track, monitor, stalk, harass or harm anyone, or to get information about another person;
(d) give false information or impersonate anyone;
(e) use bots, scrapers or other automated means to access the Services, or submit the Free Check form in bulk;
(f) probe, scan or test the vulnerability of the Services, or interfere with their security or operation;
(g) copy, modify, reverse engineer, resell or commercially exploit the Services;
(h) use the Services or any Report for employment, tenant, credit, insurance or other eligibility decisions, or for any purpose covered by the Fair Credit Reporting Act (we are not a consumer reporting agency);
(i) threaten, abuse or harass our staff; or
(j) use the Services in violation of any law.
The Services rely on third parties that we do not control. These include Data Brokers, the Breach Database provider, our payment processor, Apple Pay, Google Pay, our email provider and Meta. Their own terms and privacy policies govern their services. We are not responsible for their content, availability, accuracy or practices. Links to third-party websites are for convenience only and are not endorsements.
16.1 Ownership. We and our licensors own the Site and the Services, including all software, text, graphics, Reports, scores and trademarks. You may use the Site and your Reports only for your personal, non-commercial use under these Terms. Screenshots in a Report show third-party websites, which belong to their owners. We reserve all rights not expressly granted.
16.2 Feedback. If you send us suggestions or feedback, we may use them without any obligation to you.
17.1 THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." EXCEPT AS EXPRESSLY STATED IN THESE TERMS, AND TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY. THIS INCLUDES ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. IN PARTICULAR, WE DO NOT WARRANT:
(a) THAT ANY INFORMATION WILL BE FOUND, REMOVED OR STAY REMOVED;
(b) THAT THE FREE CHECK'S SCORE OR GENERAL INFORMATION IS ACCURATE FOR YOU;
(c) THAT BREACH DATA FROM THE BREACH DATABASE OR OTHER THIRD PARTIES IS COMPLETE OR CURRENT; OR
(d) THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS.
17.2 Our commitment and your remedy. We will provide the paid Services described in Section 4.2 with reasonable care. If we fail to do so, tell us. We will then either re-perform the affected Services promptly or, if we cannot, refund the affected month's payment in full to your original payment method. This is your sole remedy for that failure, except where the law gives you a remedy that cannot be waived.
18.1 Excluded damages. TO THE FULLEST EXTENT THE LAW ALLOWS, NEITHER WE NOR OUR OFFICERS, EMPLOYEES, CONTRACTORS OR AGENTS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS OR LOST DATA, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS. THIS APPLIES EVEN IF WE WERE TOLD THESE DAMAGES WERE POSSIBLE.
18.2 Cap. TO THE FULLEST EXTENT THE LAW ALLOWS, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
(a) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE LIABILITY; OR
(b) ONE HUNDRED U.S. DOLLARS (US $100).
18.3 Third parties. We are not liable for the acts or omissions of Data Brokers, the Breach Database provider, payment processors, email providers or other third parties we do not control.
18.4 What this Section does not limit. Nothing in Sections 17 or 18 limits or excludes:
(a) liability for our fraud, gross negligence or willful misconduct;
(b) our obligation to give any refund you are owed under these Terms, our Refund & Cancellation Policy or the law; or
(c) any other liability, or any right you have, that the law does not allow to be limited or waived by contract.
18.5 Basis of the bargain. These limits reflect a reasonable allocation of risk. They are an essential part of the bargain between you and us, and our prices reflect them.
19.1 Your obligation. To the extent the law allows, you agree to indemnify us and our officers, employees and contractors against third-party claims, and the resulting losses, damages and reasonable costs (including reasonable attorneys' fees), to the extent they arise from:
(a) information you gave us that was false, or that you were not authorized to give;
(b) your adding a person to a Family plan, or asking us to act for anyone, without the authority required by Section 7; or
(c) your breach of Section 14 (Acceptable Use).
19.2 Limits. You do not have to indemnify us for claims caused by our own negligence, misconduct or breach of these Terms.
19.3 Process. We will notify you promptly of any claim covered by this Section. We may control the defense and settlement of the claim, and you will cooperate with us. We will not settle such a claim in a way that requires you to pay money or admit fault without your consent.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. IT REQUIRES YOU AND US TO RESOLVE MOST DISPUTES IN INDIVIDUAL ARBITRATION INSTEAD OF COURT. IT ALSO WAIVES CLASS ACTIONS AND, WHERE THE LAW ALLOWS, JURY TRIALS. YOU MAY OPT OUT WITHIN 30 DAYS (SECTION 20.11).
20.1 What this Section covers. "Dispute" means any dispute, claim or controversy between you and us that arises out of or relates to the Services, these Terms, our communications with you, or our privacy practices, including our use of cookies, analytics and the Meta Pixel. It includes statutory, contract, tort and other claims, and claims that arose before you accepted these Terms. "We" and "us" in this Section include our officers, employees, contractors and agents, but only for Disputes that arise from their work for SAVE.
20.2 Informal resolution comes first. Before starting an arbitration or a small-claims case, the party with the Dispute must send the other party a written Notice of Dispute.
(a) Sending the Notice. Send yours by email to [email protected] or by mail to NEXT MATH INC, Attn: Legal, 220 East 23rd Street, STE 400, New York, NY 10010. We will send ours to the email address we have for you.
(b) What the Notice must include. Each Notice must concern one person's individual claim. It must include that person's name and the email address they used with SAVE, a description of the Dispute, and the relief requested. It must be signed by that person and by their lawyer, if they have one.
(c) The 60-day period. For 60 days after the Notice is received, we will both try in good faith to resolve the Dispute. If either party asks, the person with the Dispute and a SAVE representative with authority to settle will each personally attend one individual video or phone conference. Lawyers may also attend. Statutes of limitation are tolled during this 60-day period.
(d) Effect. Neither party may start an arbitration or a small-claims case until this process is complete. A court may enforce this Section 20.2.
20.3 Agreement to arbitrate. If a Dispute is not resolved under Section 20.2, either party may start an arbitration. You and we agree that, except as Section 20.4 provides, every Dispute will be resolved by final and binding arbitration on an individual basis. The Federal Arbitration Act governs this Section 20.
20.4 Exceptions. The following do not have to be arbitrated:
(a) Small claims. Either party may bring an individual claim in small-claims court in your county of residence or in New York County, New York, if the claim qualifies and stays there on an individual basis.
(b) Interim relief. Either party may ask a court for a temporary restraining order or preliminary injunction to stop unauthorized access to or interference with the Services, or infringement of intellectual property, but only to preserve the status quo while the arbitration is pending. The arbitrator decides the merits.
(c) Public injunctive relief. Requests for public injunctive relief are handled as described in Section 20.9(c).
20.5 Administrator and rules.
(a) The American Arbitration Association ("AAA") will administer the arbitration under its Consumer Arbitration Rules. Where they apply, the AAA's Mass Arbitration Supplementary Rules will also govern (Section 20.10). Both are referred to here as the "AAA Rules", and they are available at www.adr.org. If the AAA Rules conflict with this Section 20, this Section controls, to the extent the AAA Rules allow.
(b) If the AAA is unavailable or will not administer the arbitration, the parties will agree on another administrator. If they cannot agree, a court will appoint one under the Federal Arbitration Act.
(c) To start an arbitration, file a demand with the AAA and send a copy to the other party at the address in Section 20.2(a).
20.6 Fees.
(a) The AAA Rules govern filing, administration and arbitrator fees. Under the AAA's consumer fee schedule, your share is limited to a filing fee. We pay the rest of the AAA's fees and the arbitrator's compensation.
(b) If you prevail in the arbitration, we will reimburse your filing fee. If you show the arbitrator that you cannot afford the filing fee, we will pay it.
(c) Each party pays its own attorneys' fees and costs, unless the arbitrator awards them under a law that allows it. We will not seek our attorneys' fees from you unless the arbitrator finds that your claim was frivolous or brought for an improper purpose.
20.7 The arbitration.
(a) The arbitrator. One arbitrator will decide the Dispute.
(b) Format. If your claim is for $25,000 or less, it will be decided on written submissions unless either party asks for a hearing or the arbitrator decides one is needed. Any hearing will take place by video or phone, unless the arbitrator decides an in-person hearing is needed. Any in-person hearing will be held in the county where you live.
(c) Relief. The arbitrator may award, on an individual basis, the same damages and other relief a court could award on that person's individual claim. Any injunctive or declaratory relief is limited to what is needed to provide relief on that person's individual claim.
(d) Decision. The arbitrator will issue a written decision explaining the essential findings and conclusions. Judgment on the award may be entered in any court with jurisdiction.
(e) No precedent. An award has no preclusive effect on any claim by any other person.
20.8 Who decides what. The arbitrator decides all questions about the arbitrability, scope, interpretation and enforceability of this Section 20, except that a court decides:
(a) whether Section 20.9 (class action waiver) or Section 20.10 (mass arbitration) is enforceable, and how it applies;
(b) whether a party has complied with Section 20.2 (informal resolution); and
(c) whether you validly opted out under Section 20.11.
20.9 Class action waiver.
(a) Individual claims only. YOU AND WE MAY BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims of different people, except as Section 20.10 provides for administration. The arbitrator may not preside over any class, collective or representative proceeding.
(b) If the waiver is unenforceable. If a court finally decides that this class action waiver is unenforceable for a particular claim or request for relief, that claim or request (and only that one) will be severed and decided in court, not in arbitration. All other claims will still be arbitrated individually.
(c) Public injunctive relief. If you seek public injunctive relief, and a court finally decides that the law does not allow you to waive that relief, that request will be severed and decided in court. The court case will be paused until the individual claims have been arbitrated.
20.10 Mass arbitration. This Section applies if 25 or more similar demands for arbitration are filed against us, or by us, by the same or coordinated lawyers or organizations ("Mass Filing").
(a) Rules. The AAA's Mass Arbitration Supplementary Rules and mass arbitration fee schedule apply.
(b) Batches. The demands will be administered in batches of up to 100 demands each, with any remainder forming a final batch. Each batch will be assigned to one arbitrator, and filing and administrative fees will be charged per batch to the extent the AAA Rules allow. All batches may be filed at the same time and will proceed in parallel. No claimant has to wait for another batch to finish.
(c) Individual decisions. In each batch, the arbitrator must decide each claimant's claim individually, on its own facts and merits, and may issue a separate award for each. A decision on one claimant's claim does not bind any other claimant.
(d) Pre-filing requirements. Each claimant must have completed the informal resolution process in Section 20.2 individually.
(e) Tolling. Statutes of limitation for each claim in a Mass Filing are tolled from the date the claimant's Notice of Dispute is received until that claimant's demand is assigned to an arbitrator.
(f) Enforcement. A court may enforce this Section 20.10, including by stopping the filing or administration of demands that do not comply with it.
(g) Small claims. Any claimant in a Mass Filing may instead pursue an eligible claim in small-claims court under Section 20.4(a).
20.11 Your right to opt out.
(a) How to opt out. You may opt out of this agreement to arbitrate by sending us a written opt-out notice within 30 days after you first accept these Terms. You first accept them when you first submit the Free Check form, first complete checkout or, as a Family Member, first sign your authorization under Section 7.3, whichever comes first. Send the notice by email to [email protected] or by mail to the address in Section 20.2(a).
(b) What to include. Include your name, the email address you gave us, and a clear statement that you opt out of arbitration.
(c) Effect. If you opt out, Sections 20.3 to 20.10 do not apply to you, and the rest of these Terms still apply. Opting out has no other effect on your relationship with us.
(d) No group opt-outs. Your opt-out applies only to you. One person cannot opt out for another, and lawyers cannot send group opt-outs.
20.12 Jury trial waiver. If a Dispute is decided in court for any reason, YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL, TO THE EXTENT THE LAW ALLOWS. This Section 20.12 does not apply to residents of California or Georgia (Section 24).
20.13 Changes to this Section. If we make a material change to this Section 20, Section 23.4 applies.
20.14 Severability. Except as Sections 20.9(b) and 20.9(c) provide, if any part of this Section 20 is found unenforceable, that part will be severed and the rest of Section 20 will remain in effect.
20.15 Survival. This Section 20 survives the end of your use of the Services and of any Subscription.
21.1 Governing law. The Federal Arbitration Act governs Section 20. Otherwise, the laws of the State of New York govern these Terms, without regard to its conflict-of-laws rules. However, if you live in another state, you keep the protection of that state's consumer protection laws that cannot be waived by contract.
21.2 Venue. Any Dispute that is not arbitrated will be decided only in the state or federal courts located in New York County, New York. You and we consent to their personal jurisdiction. However, you may bring or defend a Dispute in the courts of your county of residence where your state's law gives you that right, and small-claims cases may be brought as Section 20.4(a) allows.
22.1 By you. You may stop using the Services at any time. To end a Subscription, cancel as described in Section 10.
22.2 By us, for cause. We may suspend or end your access to the Services, or your Subscription, if:
(a) you materially breach these Terms;
(b) you give false information, or act without the authority required by Section 7;
(c) we reasonably believe that the Subscription was bought with a payment method you were not authorized to use, that you are using the Services for fraud, or that you disputed in bad faith a charge you authorized for Services you received (for example, disputing a charge we had already refunded);
(d) you threaten or harass our staff, or keep sending abusive messages to them after we have warned you in writing;
(e) we cannot verify your identity or authority after reasonable attempts; or
(f) continuing would violate the law or expose us or others to legal risk.
Where practicable, we will tell you the reason and give you a chance to fix the problem first. If we end your Subscription under (a), (b), (c) or (d), we will not refund the current month, unless the law requires it or the charge was unauthorized (Section 11.3(a)). If we end it under (e) or (f), we will refund the unused part of the current month, prorated by day.
22.3 By us, without cause. We may end your Subscription for any other reason, or stop offering the Services, by giving you at least 30 days' notice by email. Where reasonably possible, we will do this at the end of a paid month. If we end your Subscription during a paid month, we will refund the unused part of that month, prorated by day.
22.4 What happens when the Services end.
(a) Our appointment as your authorized agent ends (Section 6.7).
(b) Requests already submitted stay with the sites that received them.
(c) We keep and delete information as our Privacy Policy describes.
(d) These Sections survive the end of the Services: 3.2, 3.3, 4.6, 4.8, 5, 6.6, 6.7(b), 9.7, 11 and 12.3 (for refunds already owed), 13.3, 13.4, 14 to 21, 24 and 25.
23.1 Updates. We may update these Terms. When we do, we will post the new version on the Site and change the "Last updated" date.
23.2 Notice of material changes. If a change materially affects Subscribers, we will email you at least 10 days and no more than 30 days before it takes effect (price changes follow Section 12.2). The email will state the change, its effective date and how to cancel (https://saveprivacy.net/cancel), and you can keep it. A change does not apply to you before its effective date.
23.3 Acceptance. Updated Terms apply from their effective date. If you keep using the Services, or keep your Subscription active, after that date, you accept the updated Terms. If you do not agree, stop using the Services and cancel your Subscription before that date. Changes never apply to a payment made before the change took effect.
23.4 Changes to arbitration.
(a) Changes to Section 20 never apply to a Dispute for which a Notice of Dispute was sent, or an arbitration or court case was started, before the change was posted.
(b) If we make a material change to Section 20, you may reject it by sending us written notice within 30 days after the change is posted, as described in Section 20.11(a). If you reject it, the version of Section 20 that you last accepted continues to apply to you.
24.1 California residents.
(a) Consumer rights notice. This notice is given under California Civil Code Section 1789.3.
- Our name, address and telephone number are in Section 26.
- Our charges are described in Sections 4 and 9.
- To resolve a complaint about the Services or get more information about them, contact us at [email protected].
- You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
(b) Your rights under California law. If you live in California:
- nothing in these Terms waives any right you have under the Consumers Legal Remedies Act;
- Section 18.1 does not exclude punitive damages that the Consumers Legal Remedies Act or another California statute allows; and
- Section 20.12 (jury trial waiver) does not apply to you.
24.2 New Jersey residents. If you live in New Jersey:
(a) the exclusion of punitive and exemplary damages in Section 18.1 does not apply to claims under the New Jersey Consumer Fraud Act, or under any other New Jersey statute that provides for multiple or punitive damages;
(b) Sections 17.2 and 18.2 do not limit treble damages, attorneys' fees or costs available under the New Jersey Consumer Fraud Act;
(c) Sections 17 and 18 do not limit our liability for our own negligence that causes physical injury or property damage; and
(d) Section 19 does not require you to indemnify us for our own negligence or misconduct (as Section 19.2 already states).
All other provisions of these Terms apply to New Jersey residents as written.
24.3 Georgia residents. Section 20.12 (jury trial waiver) does not apply to you.
24.4 All residents. Nothing in these Terms limits any right you have under your state's automatic-renewal, consumer-protection or privacy laws that cannot be waived by contract.
25.1 Entire agreement. These Terms, together with the documents listed in Sections 1.4(a) and 1.4(b), are the entire agreement between you and us about the Services. They replace any earlier agreements on that subject.
25.2 Assignment. You may not transfer these Terms or your Subscription without our written consent. We may transfer these Terms in connection with a merger, acquisition, reorganization or sale of assets, including to a new company formed to operate SAVE. If we do, we will notify you by email, and the new owner must follow Section 6.6. If you do not want to continue with the new owner, you may cancel within 30 days after our notice, and we will refund the unused part of your current month, prorated by day.
25.3 Severability. Except as Section 20 provides, if any provision of these Terms is found unenforceable, it will be enforced to the maximum extent allowed, and the rest of these Terms will remain in effect.
25.4 No waiver. If we do not enforce a provision, that is not a waiver of our right to enforce it later.
25.5 Events beyond our control. We are not liable for any delay or failure caused by events beyond our reasonable control, such as outages of third-party services, natural disasters, or acts of government. This does not affect any refund you are owed.
25.6 Relationship. Apart from the limited authorized-agent appointment in Section 6, these Terms do not create any agency, partnership, joint venture or fiduciary relationship between you and us.
25.7 No third-party beneficiaries. No one other than you and us has rights under these Terms, except that a Family Member who has accepted these Terms may rely on Sections 6.6, 7.4, 7.5 and 7.6.
25.8 Headings and language. Headings are for convenience only. If we provide a translation of these Terms, the English version controls.
